Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and AgentStore ("AgentStore," "we," "us," or "our") and govern your use of agentstore.ai and our waitlist-related services (collectively, the "Service").

1. Scope of Service

The Service currently consists of a public website and waitlist signup flow for pre-launch updates. These Terms do not grant access to any future marketplace, developer tooling, or paid offerings that are not yet live.

2. Acceptance of Terms

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.

4. Waitlist Communications

If you submit your email to the waitlist, you consent to receive waitlist and launch-related communications from us. You can unsubscribe at any time via our self-serve unsubscribe page and you can request data export or deletion via our self-serve privacy controls page or by contacting privacy@agentstore.ai.

Joining the waitlist does not guarantee acceptance, access timing, pricing, features, or availability of any future product.

5. Your Responsibilities

You agree not to:

  • Use the Service in violation of applicable law.
  • Interfere with site operation, security, or availability.
  • Submit false, misleading, or unauthorized personal information.
  • Attempt automated scraping or abusive traffic generation.
  • Transmit malware, exploit code, or harmful content.

6. Intellectual Property

The Service and its content, design, and branding are owned by AgentStore or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted, no license is granted.

7. Third-Party Services

We may use third-party providers for hosting, analytics, advertising attribution, and email delivery. Your use of the Service may involve those providers' processing under our instructions and their own terms where applicable.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, AgentStore will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service.

To the maximum extent permitted by law, AgentStore's aggregate liability for all claims relating to the Service will not exceed the greater of (a) USD $100 or (b) amounts you paid us for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AgentStore from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or violation of these Terms.

11. Dispute Resolution, Arbitration, and Class Waiver

11.1 Informal resolution first

Before filing a claim, you and AgentStore agree to attempt to resolve disputes informally by sending written notice to hello@agentstore.ai. If a dispute is not resolved within 30 days, either party may proceed as allowed below.

11.2 Binding arbitration

Except for claims eligible for small claims court and claims for injunctive relief related to intellectual property or misuse of services, disputes will be resolved by binding arbitration administered by the American Arbitration Association under applicable consumer arbitration rules.

Arbitration will be conducted in English and may proceed remotely where permitted. The Federal Arbitration Act governs interpretation and enforcement of this arbitration section.

11.3 Class action waiver

You and AgentStore agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated, representative, or private attorney general proceeding, except where such waivers are prohibited by law.

11.4 Arbitration opt-out

You may opt out of arbitration and class waiver within 30 days of your first acceptance of these Terms by emailing hello@agentstore.ai with subject line "Arbitration Opt-Out" and identifying details for your request.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules, except where preempted by federal law or where non-waivable consumer protections apply.

13. Termination

We may suspend or terminate access to the Service at any time for security, legal, or misuse reasons. You may stop using the Service at any time.

14. Changes to Terms

We may update these Terms from time to time. Updated Terms become effective when posted, unless a different effective date is stated. Continued use of the Service after updates means acceptance.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Notice, are the entire agreement between you and AgentStore regarding this waitlist-stage Service.
